1. Purpose
These Terms govern the use of everyais studio (the "Service") operated at studio.everyais.com by BROZ Inc. (the "Company") and define the rights, obligations, and responsibilities of the Company and its users.
2. Definitions
- "User" means a member who accepts these Terms and uses the Service.
- "Credits" are the in-service units used to calculate and settle fees for image generation and other paid features.
- "Content" means prompts, images, settings, and other material submitted or uploaded by a User, as well as images and related information generated through the Service.
- "Interactive Generation" starts processing promptly after a request, while "Batch Generation" processes a larger number of images asynchronously.
- "Subscription" means a product that provides Credits for recurring service periods.
- "AI Provider" means a third-party provider of image-generation models, such as Google Gemini.
3. Posting and Changes
The Company makes these Terms available within the Service.
The Company may amend these Terms to the extent permitted by applicable law. We will state the effective date and reason, and will provide at least 30 days' notice of a material change that disadvantages Users.
If you do not agree to amended Terms, you may stop using the Service and terminate your account. We will obtain renewed consent where required by law.
4. The Service
- AI-assisted image generation and editing
- Interactive and high-volume Batch Generation with progress and result tracking
- Generation history, folders, downloads, and generated-data retention
- A public gallery for eligible free-credit outputs where the User has separately opted in
- Credit purchases, recurring subscriptions, coupons, and payment history
- Business inquiries and feature or model requests
5. Registration and Accounts
- An agreement is formed when an applicant accepts the required terms and the Company approves registration.
- You must provide accurate information and keep it current.
- You are responsible for securing your sign-in method and account and may not transfer or lend the account to another person.
- You must promptly notify the Company if you become aware of unauthorized account use.
- The Service is not intended for children under 14.
6. User Obligations and Prohibited Use
You must follow applicable law, these Terms, and in-service guidance. You may not:
- impersonate another person or misuse or infringe another person's rights;
- create illegal, fraudulent, violent or terrorist, child sexual exploitation, hateful or harassing, or non-consensual impersonation or deepfake content;
- submit, generate, or distribute content that infringes copyright, trademark, publicity, privacy, or other rights;
- circumvent security, request limits, or access controls, or place an unreasonable load on the Service; or
- distribute malware, reverse engineer the Service, use unauthorized automation, resell accounts or Credits, or otherwise disrupt normal operations.
7. AI-Generated Content
You retain the service usage rights in the Content you submit and the outputs you generate. The Company does not claim ownership of your outputs or charge a separate royalty for their use.
Whether an AI-generated work qualifies for copyright protection depends on the jurisdiction and manner of use. The Company does not guarantee that an output is copyrightable or free of third-party rights.
Outputs may contain errors, bias, or unexpected elements. You are responsible for reviewing outputs, determining whether they are suitable for your intended use, securing necessary rights, and deciding how to use them.
8. Public Gallery
- An image paid for entirely with welcome, coupon, or other free Credits becomes eligible for review only if the User separately opts in to gallery publication.
- If approved, the image may be published together with its prompt, model, resolution, and related generation details.
- Images paid for in whole or in part with purchased or subscription Credits are excluded.
- You may withdraw gallery consent at any time in Settings. Withdrawal removes published and pending entries.
9. Credits and Charges
- Credits required for generation are set aside when a job starts and are finally charged only for successful images.
- Credits set aside for failed or cancelled images return with their original expiry. Credits that have already expired by the time of return are not restored.
- The pricing page or checkout screen states current prices, model rates, and bonus conditions.
- Credits with the nearest expiry are used first. The applicable validity period is shown when Credits are granted or purchased.
- Free, coupon, and bonus Credits are not redeemable for cash or transferable to another account.
10. Subscriptions and Generated-Data Retention
- A recurring subscription renews for each billing period unless you cancel automatic renewal.
- Subscription Credits are granted and expire according to the applicable service period and product conditions.
- Outputs funded by welcome, coupon, or ordinary admin Credits are retained for 30 days after completion; outputs funded by separately purchased Credits are retained for 365 days.
- Outputs funded by subscription base or bonus Credits are retained for up to 365 days after completion, capped at 30 days after all paid access ends when that date is earlier. Cancellation uses the already-paid period end, not the cancellation-request date.
- When multiple Credit types are actually settled, the longest retention right applies. Resubscribing recalculates still-undeleted subscription outputs within the 365-day maximum.
- A result published in Gallery Studio is exempt from expiry while published, but delisting, consent withdrawal, and account deletion take priority. Pending review is not exempt. Download important results before they expire.
11. Payment, Cancellation, and Refunds
Payments are processed through the payment processor designated by the Company. Before paying, you must review the product, amount, billing cycle, and refund terms shown at checkout.
You may request cancellation of unused paid Credits or a product whose supply has not begun within the period provided by applicable law. Once digital content, Credits, or subscription benefits have been supplied or used, cancellation or refunds may be limited where the law permits.
Verified overpayments are generally returned to the original payment method. Use the in-service guidance or the privacy contact details below to make a request.
12. Changes and Interruptions
The Company may change or temporarily suspend all or part of the Service for quality improvements, technical or security needs, maintenance, or an AI Provider issue.
We will give advance notice of a reasonably foreseeable material change or interruption and prompt notice afterward in an emergency. Service may be delayed by events outside our reasonable control, including natural disasters, network failures, or AI Provider outages.
13. Service Intellectual Property
The Company or its licensors retain rights in the Service software, interface, design, trademarks, logos, and Company-authored content. These Terms grant no rights beyond the limited right to use the Service as intended.
14. Restrictions and Termination
- You may ask the Company to terminate your account at any time.
- The Company may restrict or terminate access after notice if you violate law or these Terms or create a material risk to the Service or others. We may restrict access first and notify you afterward where an urgent security or safety risk exists.
- On termination, User information and stored Content are handled under the Privacy Policy, except records that must be preserved by law. Download any outputs you need before termination.
15. Disclaimers and Liability
The Company does not guarantee the accuracy, completeness, fitness for a particular purpose, or non-infringement of AI outputs. You are responsible for disputes arising from your instructions, Content, or manner of use.
Unless caused by willful misconduct or gross negligence, the Company is not liable for loss caused by events beyond reasonable control, an AI Provider or network outage, or a User's act or omission. To the extent permitted by law, liability is limited to ordinary and direct loss.
Nothing in this section excludes liability that cannot be limited under applicable consumer-protection or other law.
16. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Korea. The parties will first try to resolve disputes through consultation. Any court action must be brought in a court with jurisdiction under Korean civil-procedure law, without limiting a consumer's right to use an applicable dispute-resolution body.
